Collective Rent

1. The Website enables the conclusion of a Rental Agreement via the Internet. The conclusion of the Rental Agreement between the Customer and the Service Provider takes place after selecting the Product of interest to the Customer and placing the Rental Order by the Customer via the Rental and Order Form. The use of the Rental and Order Form begins when the Service User selects the Product. Placing an order takes place after the Service User completes a total of two subsequent steps - (1) after completing the Rental and Order Form and (2) after completing the Rental and Order Form, clicking the "I am renting" field - until then, it is possible to modify the entered data yourself (for this purpose please follow the displayed messages and information available on the Website). In the Rental and Order Form, it is necessary for the Service Recipient to provide the following data regarding the Service Recipient: name and surname, e-mail address, contact telephone number, contract data: Product(s), quantity of the Product(s), place and method of delivery of the Product(s), method of payment and attaching a scan of your ID card or passport. In the case of Service Recipients who are not consumers, it is also necessary to provide the company name and NIP number

2. The rental cost shown on the Website is given in Polish zlotys, British pounds, euros or US dollars and includes taxes. The Customer is informed about the total Rental Price, as well as delivery costs (including transport, delivery and postal services fees) and other costs, and if the amount of these fees cannot be determined - about the obligation to pay them, on the website of the Website when placing the order. Rental Orders, including when the Customer expresses his will to be bound by the Rental Agreement.

3. After submitting the Rental Order using the Rental and Order Form, the Service Provider verifies the data provided, then immediately confirms its receipt and simultaneously accepts the Rental Order for execution. If the entered data is found to be incorrect, before accepting the Rental Order for execution, the Service Provider contacts the Customer to correct the data provided. Confirmation of receipt of the Rental Order and its acceptance for execution takes place by displaying appropriate information on the Website and by sending the Service Provider to the Customer an appropriate e-mail to the Customer's e-mail address provided when submitting the Rental Order, which contains at least the Service Provider's declaration of receipt of the Order. Loan and its acceptance for implementation and confirmation of conclusion of the Loan Agreement. When the Customer receives information about the acceptance of the Rental Order for execution, a Product Rental Agreement is concluded between the Customer and the Service Provider.

4. The content of the concluded Rental Agreement is recorded, secured and made available to the Customer by the Service Provider by (1) making these Regulations available and (2) sending the content of the concluded Rental Agreement to the Customer via e-mail. The content of the Rental Agreement is additionally recorded and secured in the Website's IT system.

5. The condition for the release of the Product by the Service Provider is the payment by the Customer of the Initial Fee and the price for the first month or year in the amount specified when placing the Rental Order.

6. The Rental Agreement is concluded for the Rental Period. The beginning of the Rental Period is the First Rental Day. If the Rental Period expires, the Rental Agreement is automatically extended for another, same Rental Period, unless the Customer resigns from the Rental Agreement, about which he informs the Service Provider, for example via e-mail sent to the following address: info@xobox.co.uk, in within 2 calendar days from the end of the last Rental Period. In the event of an extension of the Loan Agreement, the terms of the original Loan Agreement apply.

7. If the Customer resigns from extending the Rental Agreement for the next Rental Period, the Customer is obliged to return the Product that is the subject of the Rental Agreement no later than on the last day of the Rental Period (Monday to Friday from 09:00 to 17:00), and in If the last day of the Loan Period does not fall on a Business Day, the return should be made on the next Business Day to the following address: Polska - Proboszczewice 28, 09-131 Joniec | United Kingdom - 23 Northfirld Road, RM95UR Dagenham. If the Customer fails to return the Product on the last day of the Rental Agreement, the Service Provider is entitled to charge the Customer fees for non-contractual use of the Product.

8. The Customer is obliged to use the Product that is the subject of the Rental Agreement only during the Rental Period, in the manner specified in these Regulations and in a manner consistent with its properties and purpose.

9. The Customer is obliged to return the Product in undeteriorated condition, but is not responsible for any wear and tear of the Product resulting from proper use. In the event of damage to the Product caused by the Customer's fault, the Service Provider has the right to claim compensation for the damage within the limits provided by law.

1. The Service Provider is obliged to provide the Customer with a functional, usable Product.

2. If a defect or damage to the Product is found during its release, it is recommended to mark the identified defects or damage on the Product acceptance report and immediately notify the Service Provider about it, for example by e-mail sent to the following address: info@xobox.co.uk or by phone ( +48519851433 | +447429112423). Failure to meet the above requirements does not affect the manner in which the complaint will be considered by the Service Provider, but may speed it up.

3. In the event of a defect or damage to the Product, the Service Provider will immediately replace the Product with another, functional Product free of charge. The exchange time is not included in the Rental Period. However, this does not exclude the Customer's other rights under the law.

4. The Customer is obliged to use the Product in accordance with its intended use and operating instructions, as well as in accordance with generally applicable laws.

5. The Customer is obliged not to transfer the Product to third parties without the express consent of the Service Provider.

6. Upon receipt of the Product, until the Product is returned to the Service Provider, the risk of loss of the Product and damage to the Product passes to the Customer.

7. In the event of a failure, loss or damage of the Product during the Rental Period, the Customer is asked to immediately inform the Service Provider about the problem via e-mail sent to the following address: info@xobox.co.uk. Moreover, the Customer is asked to urgently return the Product to the Service Provider - if possible.

8. In the event of returning a damaged Product, the Service Provider has the right to charge the Customer with actual, justified costs that occurred due to damage to the Product due to the Customer's fault.

9. The Customer is not authorized to independently interfere with the Product, including dismantling it, violating warranty protection, including the seal or interfering with the Product's software, beyond its normal use.

1. The Service Provider provides the Customer with the following payment methods under the Rental Agreement and the Sales Agreement:

a. Payment by transfer to the Service Provider's bank account;

b. Electronic payments and card payments via PayPal.com. Settlement of transactions with electronic payments and payment cards is carried out in accordance with the Customer's choice via the stripe.com website. Electronic and payment card payments are handled by Stripe.com - a PayPal company (USA) 354 Oyster Point Boulevard, San Francisco, California, 94103.

2. Available payment methods are indicated when placing the Rental Order and when completing the Rental and Order Form.

3. The Customer is obliged to make a payment under the Rental Agreement within 7 calendar days from the date of conclusion of the Rental Agreement, but no later than 2 days before the First Day of Rental.

4. The Customer is obliged to make a payment under the Sales Agreement within 7 calendar days from the date of conclusion of the Sales Agreement.

5. The Service Provider provides the Customer concluding the Rental Agreement with the option of making payments in the subscription model. In such a case, the Customer is obliged to make payments on a monthly or annual basis.

1. Delivery of the Product to the Customer is subject to payment, unless the Rental Agreement or Sales Agreement provides otherwise. Product delivery costs (including transport, delivery and postal services fees) are indicated to the Customer before the Customer expresses his will to be bound by the Rental Agreement or Sales Agreement.

2. The Service Provider provides the Customer with the following methods of Product delivery:

a. Postal shipment,

b. Courier delivery.

c. Parcel locker shipment.

3. The delivery time of the Product to the Customer is up to 30 Business Days. The beginning of the delivery period of the Product to the Customer is counted from the date of crediting the Service Provider's bank account or settlement account.

1. The consumer is not entitled to withdraw from a distance contract, among others: in relation to contracts for the provision of services, if the Service Provider has fully performed the service with the express consent of the consumer, who was informed before the provision of services that after the provision of services by the entrepreneur, he will lose the right to withdraw from the contract.

2. Subject to point 13.1 of the Regulations, a consumer who has concluded a distance contract may withdraw from it within 14 calendar days without giving a reason and without incurring costs, except for the costs specified in point. 13.4 of the Regulations.

3. A sample withdrawal form is included in Annex No. 2 to the Consumer Rights Act and is additionally available in point. 18 of the Regulations. The consumer may use the template form, but this is not obligatory.

4. Possible costs related to the consumer's withdrawal from the contract, which the consumer is obliged to bear:

- If the consumer has chosen a method of delivery of the Product other than the cheapest standard delivery method available on the Website, the Service Provider is not obliged to refund the additional costs incurred by the consumer.
- The consumer bears the direct costs of returning the Product.
- In the case of a Product that is a service, the performance of which - at the express request of the consumer - began before the deadline for withdrawal from the contract, the consumer who exercises the right to withdraw from the contract after submitting such a request is obliged to pay for the services provided until the withdrawal from the contract. The payment amount is calculated in proportion to the scope of the service provided, taking into account the price or remuneration agreed in the contract. If the price or remuneration is excessive, the basis for calculating this amount is the market value of the service provided.

5. The period for withdrawal from the contract begins:

- for a contract under which the Service Provider delivers a movable item, being obliged to transfer its ownership - from the consumer or a third party indicated by him other than the carrier taking possession of such an item, and in the case of a contract that: (1) covers many such items that are delivered separately, in batches or in parts - from taking possession of the last such item, batch or part, or (2) consists in the regular delivery of such items for a specified period of time - from taking possession of the first such item;
- for other contracts - from the date of conclusion of the contract.

6. The consumer is responsible for reducing the value of the item resulting from using it in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of the item.

7. The Service Provider is obliged to immediately, no later than within 14 calendar days from the date of receipt of the consumer's declaration of withdrawal from the contract, return to the consumer all payments made by him, including the costs of delivery of the Product (except for additional costs resulting from the method of delivery chosen by the consumer). other than the cheapest regular delivery method available on the Website). The Service Provider refunds the payment using the same payment method used by the consumer, unless the consumer has expressly agreed to a different method of return that does not involve any costs for him. If the Service Provider has not offered to collect the Product from the consumer himself, he may withhold the refund of payments received from the consumer until he receives the Product back or until the consumer provides proof of sending it back, depending on which event occurs first.

8. Statements addressed to the Service Provider can be sent in accordance with the contact details provided in point. 11. Regulations. The Consumer is obliged to immediately, no later than within 14 calendar days from the date on which he withdrew from the contract, return the Product to the Service Provider or hand it over to a person authorized by the Service Provider to collect it, unless the Service Provider has offered to collect the Product himself. To meet the deadline, it is enough to return the Product before its expiry. The consumer may return the Product to the following address: Balkonowa 5/19, 03-329 Warszawa.

9. Pursuant to Art. 96 section 6 of the Act of September 6, 2001, Pharmaceutical Law (consolidated text: Journal of Laws of 2008, No. 45, item 271, as amended), foodstuffs for particular nutritional uses and medical devices issued from the Website are not subject to return. A medical device may be returned only due to a quality defect or incorrect issue. The reservation referred to in the previous sentences does not apply to the Product returned due to a quality defect, incorrect dispensation or falsification of the medicinal product.

10. The provisions relating to consumers contained in this point 13 of the Regulations apply from January 1, 2021 and for contracts concluded from that date also to the Service Recipient who is a natural person concluding a contract directly related to his business activity, when the content of this contract stipulates, that it does not have a professional character for this person, resulting in particular from the subject of the business activity carried out by him, made available on the basis of the provisions on the Central Registration and Information on Economic Activity.
